- Provider — Tyfoon, providing access to the Platform.
- User — an individual registered on the Platform.
- Platform — the tyfoon.kz website and all its subdomains, as well as associated mobile and desktop applications.
- Service — a set of educational services provided through the Platform.
- AI Systems — artificial intelligence algorithms used by the Platform for code review, assessment of answers, and summarization of lessons.
- Authorized Processors — third-party services that process User data on behalf of the Provider: OpenAI, Google, Fireflies.ai.
1. General Provisions
1.1. The Tyfoon platform provides access to educational programming materials, automated AI-based code review tools, and an online consultation system.
1.2. These Terms constitute a public offer and a contract of adhesion in accordance with Articles 389 and 395 of the Civil Code of the Republic of Kazakhstan.
1.3. Registration of an account or use of any Platform functionality is recognized as a full and unconditional acceptance of these Terms.
1.4. These Terms are the core document. The following documents are considered incorporated into these Terms by reference and constitute an integral part thereof:

- Educational Disclaimer
- Consultation Recording Consent
In the event of a conflict between these Terms and any of the listed documents, these Terms shall prevail, unless explicitly stated otherwise.
2. Account
2.1. The User is obliged to provide up-to-date information upon registration and bears sole responsibility for the security of their credentials.
2.2. Each User is entitled to only one account. The creation of multiple accounts without the written consent of the Provider is prohibited.
2.3. The User is not allowed to transfer access to their account to third parties.
3. Use of AI Systems
3.1. The Platform uses AI algorithms to analyze the source code, automatically evaluate answers, and generate lesson summaries.
3.2. In accordance with the Law of the Republic of Kazakhstan "On Artificial Intelligence," the AI systems used on the Platform are classified as medium-risk systems. The results of their performance are accompanied by a visual label "Verified by AI" or a similar notification.
3.3. The Provider applies reasonable efforts to ensure that the results of the AI systems comply with applicable law. The Provider is not responsible for AI inaccuracies arising from the probabilistic nature of the algorithms or the misuse of AI by the User.
3.4. The User acknowledges that AI answers and recommendations are for reference and may contain inaccuracies.
3.5. The User has the right to request an explanation of the logic of AI algorithms if an automated decision significantly affects their educational progress. The procedure for submitting such requests is described in the AI Usage Policy.
3.6. Detailed conditions for the use of AI systems are governed by the AI Usage Policy.
4. Payment and Refunds
4.1. Payment for access to the Service is carried out by the User independently through external banking applications using the Provider's bank details; the Platform does not perform technical receipt of payments and does not store bank card data.
4.2. Access to paid functionality is provided only after the actual receipt of funds to the Provider's account and payment confirmation.
4.3. Refunds are handled in accordance with the Refund Policy. A refund request may be submitted within 14 calendar days from the moment of payment under the conditions provided by the Refund Policy.
5. Consultations and Recording
5.1. For conducting individual consultations, the Provider uses the third-party service Fireflies.ai for audio and video recording of calls, their transcription, and summarization.
5.2. The fact of booking a consultation in the Platform interface is recognized as explicit consent of the User to the recording of the conversation. Detailed recording conditions are governed by the Consultation Recording Consent.
6. Intellectual Property
6.1. All educational materials, design, and architecture of the Platform are the intellectual property of the Provider and are protected by copyright.
6.2. The source code written by the User during the learning process belongs to the User as the author.
6.3. The User grants the Provider a royalty-free, non-exclusive license to use their code in anonymized form for further training of the Platform's AI models. The User has the right to withdraw this consent in the account settings. Withdrawal of consent does not entail the deletion of data from already trained models.
7. Limitation of Liability
7.1. The Platform is provided on an "as is" and "as available" basis without any express or implied warranties.
7.2. The Provider is not liable for:
- interruptions in the operation of the Platform caused by failures on the part of cloud providers or third-party AI APIs;
- the results of the User's application of the acquired knowledge or code in real-world projects;
- inaccuracies in transcriptions and summaries generated by the Fireflies.ai service.
7.3. The Provider's aggregate liability to the User under any cause of action is limited to the amount actually paid by the User for the Service over the 12 months preceding the claim.
7.4. Under no circumstances shall the Provider be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profit, loss of data, or reputational damage, even if the Provider was advised of the possibility of such damages.
7.5. Educational outcomes rely on the efforts of the User; the Provider does not guarantee employment or the achievement of a specific income level.
8. Prohibited Use
Prohibited use of the Platform is governed by the Acceptable Use Policy.
9. Changes to Terms and Notification
9.1. The Provider reserves the right to amend these Terms by notifying Users through the Platform interface at least 14 days before the changes take effect.
9.2. Continued use of the Platform after the changes come into force constitutes their acceptance.
10. Applicable Law and Disputes
10.1. These Terms are governed by the laws of the Republic of Kazakhstan.
10.2. Disputes are subject to resolution in courts at the Provider's place of registration. Before applying to the court, the parties undertake to attempt to settle the dispute out of court within 30 days.
